The refund percentages stated apply to the total provider cost paid and not just the amount paid. Refund percentages apply only if the entire cost of the service is paid without any balance.
A visa refusal refund is only possible under the following circumstances and is limited to these grounds:
a) Visa denial due to incomplete documents from the client’s side.
b) Changes in immigration rules resulting in the applicant no longer qualifying under the new rule.
Immigration regulations are periodically anticipated, and clients are enrolled in advance, i.e., before the actual qualifications are announced, to ensure compliance with the cap system. It’s mutually agreed that the customer acknowledges and is willing to do so to avoid last-minute rushes and to prepare as per immigration authorities’ requirements. If the client’s profile is found ineligible after the announcement, the client can choose to switch to other options.
If the provided details of the visa program’s point system and consultancy reports are found to be false, inaccurate, deficient, or incorrect, and the visa is subsequently denied due to improper application through the services of SkyHigh, a certain amount will be refunded as per the agreement. The refund will be processed within 90 working days after the consumer submits the Refund Claim Form to SkyHigh, including a copy of the rejection letter from the Authority to support the refund claim. Failure to enclose these documents will render the customer ineligible for the refund.
SkyHigh is not liable for any delays caused by third-party services such as courier services, etc., based on external factors. Additionally, clients cannot claim reimbursement of service charges.
Clients must understand and agree that under the Australian Immigration process, partner skills assessment outcomes are subject to the determination of the relevant authorities, and SkyHigh has no control over the outcome of the application.
SkyHigh will not be responsible for refunding any fees or other amounts paid to any Assessing bodies, Immigration Authorities, Embassy/Consulate/High Commission if the applicant does not receive visa/immigration approval, or if the application is rejected or not accepted at any stage by any respective authority. The registration/processing fees only cover the expenses for the services rendered by SkyHigh and do not include any application or assessment fees. The applicant agrees to pay any additional charges applicable during processing.
If the applicant has made payment through an online card service, the applicant agrees not to withdraw or request a chargeback without SkyHigh’s consent, except as otherwise specified in the refund policy outlined in the contract and the prescribed legal procedure under Delhi’s jurisdiction. All disputes, if any, are subject to Delhi jurisdiction only.
If the applicant has made payment via credit card or internet banking, the applicant voluntarily undertakes not to dispute the payment or instruct the respective bank to initiate a chargeback, insisting on withholding or canceling the payment made to SkyHigh. This includes cases of misuse or card loss either by the applicant or any other party. The applicant agrees to cooperate with SkyHigh if necessary to represent the matter in their favor before any bank/authority.
The service charges by SkyHigh are not benchmarked against market rates and are as per the service provider’s requirements to which the client agreed. Any complaints after registration, such as fees being too expensive, will not be entertained, and the applicant will have no right to contest as it was explained and expressed through all available channels of information, and the client was informed before registering.
The applicant accepts that the immigration process may require demonstrating sufficient funds, if applicable, varying from country to country and the process/category applied for. The applicant undertakes to fulfill such requirements as desired by the relevant immigration/other authorities, and failure to provide such funds will not make SkyHigh liable for any refund of the service charges. The funds to be shown may range from INR 1-10 lakhs (the amount would increase if accompanied by dependents) as agreed by the client, and these may be required for a specified period ranging from 1-365 days tentatively and subject to change. Failure to show the same may result in denial or non-acceptance of the application, and in such cases, no refund request for service fees will be entertained.
The client also acknowledges that any registrations for any countries before the date of this customer statement agreement with SkyHigh will be nullified, and no claim of service or fee can be made unless expressly provided in writing by SkyHigh.
No refund will be made if the visa is rejected for the following reasons:
The application or processing fee paid to visa authorities or any other institution is the responsibility of the client and is not included in SkyHigh’s service charges. SkyHigh will not entertain any refund claim in case of rejection.
The client must provide all necessary documents and information within 30 days to enable SkyHigh to work on their documentation and make it submission-ready before the relevant assessing/immigration authority. The client’s failure to do so will imply no reimbursement of the advisory/consulting fee provided to SkyHigh.
The client must notify SkyHigh of every communication received from the processing visa office in writing or by phone within a week of receiving such communication. Additionally, the client shall notify SkyHigh of every communication undertaken with the concerned visa bureau within a week, both in written form and by phone. This includes visits made to the visa office and inquiries made by phone. Failure to do so will imply no refund of any secretarial fees provided to SkyHigh.
The client will participate in every interview as and when needed by the processing visa agency, at the specified location and at their own expense, and promptly follow all instructions given by the visa agency. Failure to do so will imply no refund of any secretarial fees provided to SkyHigh.
If the application/petition is returned/rejected/delayed due to an error in the application fee or mode of payment, the client agrees not to contest the withdrawal of their application on this ground as the payment and its mode are solely the client’s responsibility.
It is understood that immigration rules change from time to time. The concerned case officer may request additional information as per changing requirements, and any refund request on these grounds will not be entertained.
In the event of changes or amendments to immigration laws anytime after signing this agreement, SkyHigh is not liable for any refunds.
If the client has opted for SkyHigh’s services under the installment payment option or made a partial payment, and if immigration laws change rendering the client ineligible for the service they signed up for, no refund of any fees previously paid, including the first installment or any partial payment, will be provided.
The client understands and accepts that no refund or transfer of SkyHigh fee to a friend or relative will be processed if they abandon their application or opt-out for any reason after signing up.
The client also understands and accepts that no refund or adjustment of SkyHigh fee will be processed if they abandon the original service/procedure they signed up for and switch to another service/procedure with SkyHigh or opt for immigration to another country.
SkyHigh reserves the right to terminate/withdraw their services without refund of service fees if the client:
a) fails to submit all documents within the stipulated time, which is typically within one month of registration;
b) attempts to defame the name of the company in any manner;
c) fails to respond to communications made by the company for more than a month;
d) fails medical tests;
e) fails to provide a valid Police Clearance certificate;
f) fails to provide sufficient funds for settlement or maintenance;
g) has previously violated any immigration or visa law;
h) submits forged additional documents requested by the consulate late.
The client agrees to fulfill all requirements of the relevant authorities conducting evaluation or selecting visa outcomes. The client also agrees to submit all documents, including originals if required, to the concerned assessing authorities. Failure to submit these documents, in whole or in part, is considered a client’s independent failure, and SkyHigh is not liable for the same. Therefore, the client agrees that failure to provide documents cannot be a valid reason to claim a refund.
The client will settle all payments owed to government agencies, skills appraisal bodies, and language testing agencies such as but not limited to assessment fees, residency visa petition fees, the IELTS/French test, health tests, etc. These fees are strictly non-refundable and non-adjustable by either receiving offices or the immigration consultancy, regardless of the visa petition’s outcome. The final decision on the visa petition rests solely with the concerned authority, while the immigration consultancy exercises no control over the final outcome at any stage of the visa petition. SkyHigh provides no assurance of a positive appraisal or outcome of the client’s petition at any stage.
The client will notify SkyHigh of any changes in housing/mailing address, educational/professional credentials, marital status/employment or business, newly born children, or any police/criminal cases after submitting the petition and during processing until the release of the permanent residency permit. Failure to do so will imply no refund of any advisory fees provided to the immigration consultancy.
The client must ensure that they are married or in any recognized relationship where the spouse or appropriate dependents undergo an IELTS/French test and achieve a minimum score as required by the agreed service level agreement with SkyHigh. The client fully understands and agrees that their petition cannot be processed without the required IELTS/French scores of the marital partner, and no claim for the advisory/consulting fees provided to SkyHigh can be made if they fail to obtain the service level agreement-prescribed IELTS/French score of the marital partner. The said test, along with the related document, is essential for the documentation of married clients, even if the client does not claim points for the qualifications of their partner.
By signing/acknowledging the contract to avail our services, the client cannot withdraw at any point during the process due to personal circumstances that may have changed. Requests for refund once services have been provided or any part of the process has commenced will not be accommodated. As a business with significant investment, we cannot entertain refund requests once services have been provided or any part of the process has begun.
The client will confirm to SkyHigh if they are willing to use the substitute services of an internationally accredited assignee (Embassy/Consulate/Language test conducting centers, health check conducting centers, etc.) and make additional payments for such services to SkyHigh, as duly arranged and agreed upon under the separately inked service level agreement with the client. Any online payment will not include fees owed to such internationally accredited assignees, and under no circumstances will the fee be refunded.
The client acknowledges that they have been briefed on the typical waiting periods/processing times appropriate to their permit category, and such waiting periods/processing times depend entirely on the processing visa office/appraisal body’s discretion. The client also fully agrees and understands that they will never have any claims for any refund of the payment made on or off-site based on accelerated petition processing timeframes.
SkyHigh has not provided any assurance, recommendation, or guarantee of employment following the acceptance of a permit and after arrival in any foreign country. No claim can be made for any advisory/consulting/secretarial service fees paid to SkyHigh on the grounds that SkyHigh has been unable to provide job assurance overseas.
In a scenario where there is a conflict/dispute regarding the payment made by a client to SkyHigh for the duly inked service level agreement, SkyHigh’s liability, if any, whether financial or otherwise, shall not exceed and will be limited to the fees provided to SkyHigh as advisory/consulting/secretarial charges under the duly inked service level agreement.
Certain countries have a cap system, and therefore, visa/Green Card/permanent residence approval is subject to the cap not being reached for that year. The client may have the required points as per the immigration authorities of the specific country, but may still not get the Visa/Green Card/permanent residence if the cap has been reached for that year. Failing to obtain a Visa/Green Card/permanent residence due to the cap limit cannot be a reason for claiming a refund, and the client fully understands this.
If your refund request falls under the applicable terms and conditions of the company and the service agreement, the processing time for such a request will be 90 working days. Refund payments will be issued as a company check, payable to the individual on the order form, and will be mailed to the address indicated on it.
The client shall disclose truthfully to SkyHigh any details regarding any current or previous cases, instances of wrongdoing and/or conviction, and insolvency leveled against the client and those individuals dependent on them. Failure to disclose such details, and if discovered later, no refunds of any money given to SkyHigh in question will be made.
SkyHigh is committed to maintaining the confidentiality and privacy of a client. Therefore, SkyHigh takes reasonable steps to protect personal information collected through SkyHigh from misuse, loss, unauthorized access, alteration, or disclosure. SkyHigh may use and disclose the client’s (and if applicable, the client’s family’s) personal information for the primary purpose for which it is collected, for reasonably expected secondary purposes that are related to the primary purpose, and in other cases as permitted by the privacy Act. SkyHigh will disclose the client’s personal information for the following purposes:
Any fees paid to SkyHigh are for the provision of services listed on SkyHigh’s website. Unless otherwise stated, all fees are quoted in Indian Rupees. The client is responsible for paying all fees and applicable taxes related to our services using one of our authorized payment methods.
SkyHigh is not part of any government authority/organization or embassy. We are a solely independent company and do not have the authority to grant visas of any kind. We can only assist and advise individuals wishing to migrate or travel to their chosen country. Please note that the final decision on all visa applications rests with the relevant government departments of their respective countries.
Our agreements with clients are built on trust, honesty, and security, with each option clearly outlined. Our terms are transparent, with no hidden clauses.
The client agrees and acknowledges that the company does not endorse or force any service/product/visa, and the decision to opt for a particular service/product/visa is the client’s own choice and cannot be assumed to be a company judgment. SkyHigh educates all clients about the options without external pressure to make a decision on this service/product/visa, etc.
The applicant has read all the above provisions in detail, agrees, and continues to abide by all the terms and conditions upon signing/acknowledging this contract.
SkyHigh is operated and controlled in India, with its registered office at Nehru Place and Gurgaon.
Chargeback: It is agreed by the client that they understand that SkyHigh will deploy its staff and utilize other infrastructures to provide services to the client, involving significant expenditures. Regardless of the application’s outcome, the client hereby undertakes not to claim a refund of the fees and charges paid to SkyHigh, except to the extent provided in the agreement.
